1. Introduction

These Terms and Conditions (“Terms”) govern the purchase of bespoke furniture products (“Products”) from NovoSleep(Trading Name Of HL ltd) (“we”, “our”, or “us”). By placing an order for a bespoke furniture product, you (“Customer” or “you”) agree to be bound by these Terms.

2. Customisation and Non-Returnable Policy

All bespoke furniture products are made to your specific order and requirements. As each item is individually crafted, we do not accept returns, exchanges, or cancellations once the order has been placed.

  • Replacement Policy: In the unlikely event that the bespoke product arrives damaged or defective, we will replace the item. Any request for a replacement must be submitted within 7 days of receiving the product. We may request photographic evidence of the defect or damage to facilitate a swift resolution.
  • No Return Policy: Due to the custom nature of these products, they cannot be returned for reasons such as change of mind or dissatisfaction with the final design or dimensions.

3. Bespoke Product Consumer Rights under the United Kingdom Bespoke Product Consumer Act

As per the United Kingdom’s Consumer Rights Act 2015, you are entitled to certain statutory rights as a consumer. This includes:

  • Right to Quality: The bespoke furniture product must be of satisfactory quality, fit for purpose, and as described. If there is a fault or defect with the product at the time of delivery, you may be entitled to a replacement or refund.
  • Right to Reject: Under the Consumer Rights Act, customers have a right to reject the product if it is faulty or does not meet the agreed-upon specifications. However, this right to reject does not apply to products that are custom-made to your specific specifications.
  • Exclusions: Bespoke products are exempt from the standard “cooling-off” period for returns because they are made to order according to your individual requirements. This exemption means you are not entitled to return the product simply because you no longer want it.

4. Order Confirmation

Once you place an order, you will receive an order confirmation from us via email. This confirmation will include details of your bespoke order, including design, materials, dimensions, and estimated delivery date. Any changes to your order must be made before production begins.

5. Delivery

We will make every effort to ensure timely delivery of your bespoke furniture. However, as these products are made to order, there may be an extended lead time depending on the complexity of the design and availability of materials. We will notify you of any delays that may affect the estimated delivery date.

6. Pricing and Payment

The prices for bespoke products will be provided prior to the commencement of production. Prices are based on the materials, design, and customisation options chosen by the customer. A deposit may be required at the time of order, with the balance due upon completion of the product.

7. Liability

We are not liable for any damages or losses arising from incorrect or incomplete information provided by the customer. It is your responsibility to ensure that all measurements, specifications, and requirements are accurate before placing an order.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
